Rules of service, responsibilities of the parties and limitations of liability for Aniastepien.com Heavy Machining.

1. Subject of Services

Aniastepien.com Heavy Machining (hereinafter "the Company") provides industrial fabrication services for high-tolerance forged steel shafts and industrial gearboxes, utilizing multi-axis CNC milling centers to achieve surface finishes within micrometric thresholds. The services are intended for heavy-duty manufacturing units requiring enhanced torque transmission efficiency under extreme cyclical stress in continuous production environments.

All services are provided on a non-exclusive basis and are subject to the terms and conditions set forth in this document. The Company reserves the right to modify the scope of services upon written notice to the client.

2. Rights and Obligations of the Parties

2.1 Client Obligations

The client agrees to provide accurate and complete specifications for all fabrication orders, including but not limited to material grades, dimensional tolerances, surface finish requirements, and load parameters. The client shall ensure that all provided data is verifiable and free from errors that could affect the performance of the final product.

The client is responsible for obtaining any necessary permits or approvals required for the use of the fabricated components in their specific application.

2.2 Company Obligations

The Company commits to fabricate components in accordance with the agreed specifications, using industry-standard quality control procedures. The Company shall maintain multi-axis CNC milling centers and associated equipment in good working order to ensure consistent product quality.

The Company shall provide documentation of surface finish measurements and dimensional inspections upon request, subject to reasonable notice.

3. Limitations of Liability

The Company's liability for any claim arising from the fabrication services shall be limited to the total amount paid by the client for the specific order giving rise to the claim. In no event shall the Company be liable for consequential, incidental, or indirect damages, including but not limited to loss of production, loss of profits, or downtime costs.

The Company does not warrant that the fabricated components will be suitable for any particular application beyond the specifications expressly agreed upon in writing. The client assumes all risk associated with the use of the components in their specific operational environment.

This limitation of liability applies regardless of the form of action, whether in contract, tort, or otherwise.

4. Termination of Use

Either party may terminate a specific service agreement by providing written notice at least 30 days prior to the intended termination date. In the event of a material breach by either party, the non-breaching party may terminate the agreement immediately upon written notice.

Upon termination, the client shall pay for all services rendered up to the effective date of termination, including any non-cancellable material costs incurred by the Company.

The Company reserves the right to suspend or terminate access to any online portals or communication channels associated with the services if the client fails to comply with these terms.

5. Modification of Terms

The Company reserves the right to modify these terms of service at any time. Any changes will be communicated to clients via email or through the Company's website at least 14 days prior to the effective date of the changes.

Continued use of the Company's services after the effective date of any modification constitutes acceptance of the modified terms. If a client does not agree to the modified terms, they may terminate the agreement in accordance with Section 4.

6. Payment and Refund Policy

All payments for fabrication services are due within 30 days of the invoice date, unless otherwise agreed in writing. The Company accepts payments via bank transfer or other methods as specified on the invoice.

Refunds for defective products shall be processed only if the defect is directly attributable to the Company's fabrication process and is reported within 14 days of delivery. The Company shall, at its discretion, either repair, replace, or refund the defective product. No refunds shall be provided for products that have been modified, misused, or subjected to conditions outside the agreed specifications.

Any disputes regarding invoices must be raised in writing within 7 days of the invoice date.

7. Governing Law and Dispute Resolution

These terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these terms or the services provided shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.

The arbitration shall be conducted in English, and the seat of arbitration shall be Mumbai, India. Each party shall bear its own costs in the arbitration, unless otherwise determined by the arbitrator.
